Helpful article in Iowa State Bar's Iowa Lawyer for July on the issue of a lawyer's use of a third party to gain information off a person's Facebook or such site. Basically, you can't try to use an investigative technique [such as having 3rd parties become a 'friend' on Facebook] which is deceptive. Of course, Facebook and other social networking sites are not in any sense private and protected, and information from them can be obtained through appropriate legal process, just not by covert or deceptive tactics.
